BINDING EFFECT. These Terms of Use are a binding agreement (“Agreement”) between you and Surfmyads.com, Inc. (“Surfmyads.com,” “us,” or “we”), the owner of the Internet site located at www.surfmyads.com and its subpages (the “Site”), and any services provided in connection with the Site (the “Services”). 1. About This Site

Surfmyads.com is the corporate website of Surfmyads.com, Inc., a consumer technology company that builds and operates a portfolio of digital savings brands. The Site provides company information, brand information, partnership and careers information, and related content. The Site is not itself a coupon, voucher, or deal marketplace. Offers and shopping experiences on our consumer brands are governed by those brands' own terms and privacy policies.

2. Privacy Policy

Surfmyads.com respects your privacy and permits you to control the treatment of your personal information to the extent described in our Privacy Policy. Our Privacy Policy is expressly incorporated into this Agreement by this reference. Please review it carefully to understand how we may collect, use, and share personal data.

If you contact us by email or submit information through our careers application form, you represent that the information is accurate and that you have the right to provide it. Job applicants acknowledge that resumes and related materials may be stored, reviewed, and shared internally for recruitment purposes as described in our Privacy Policy. You agree not to submit confidential or proprietary information of third parties without authorization.

The Site may contain links to Surfmyads consumer brands and to third-party websites. These links are provided for informational purposes only and do not constitute an endorsement by Surfmyads.com. 10. No Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, SURFMYADS.COM DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SURFMYADS.COM AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

13. Arbitration; Class Action Waiver

Except where prohibited by law, any dispute arising out of or relating to these Terms or the Site shall be resolved by binding arbitration administered in Santa Clara County, California, under the rules of a mutually agreed arbitration provider. YOU AND SURFMYADS.COM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. If arbitration is not permitted for a particular claim, you agree that exclusive jurisdiction for such claim shall be in the state or federal courts located in Santa Clara County, California.

14. Choice of Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions.

15. Severability; Waiver

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

16. Modifications

Surfmyads.com may modify these Terms at any time by posting an updated version on the Site. Changes are effective when posted. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
